California Medicare Supplement Birthday Rule: How Does It Work?

If you already have a Medicare Supplement plan in California, your birthday gives you an important annual opportunity to review your coverage and potentially lower your premium.

California’s Medicare Supplement Birthday Rule allows eligible Medigap policyholders to change to another Medicare Supplement plan with equal or lesser benefits during a 60-day open enrollment period beginning on their birthday, without medical underwriting.

What Is the California Medicare Birthday Rule?

The Birthday Rule is a California consumer protection for people who already have Medicare Supplement (Medigap) coverage.

During your annual Birthday Rule period, you can apply for another Medicare Supplement policy with equal or lesser benefits without having to qualify based on your health.

This can be particularly valuable if the premium on your current Medicare Supplement has increased and you want to see whether another insurance company offers comparable coverage at a more competitive rate.

How Long Is the California Birthday Rule Window?

California provides a 60-day open enrollment period commencing with your birthday.

You don’t have to change plans every year. But your birthday gives you an annual opportunity to compare your current coverage and premium with other eligible Medicare Supplement options.

Can You Change Medicare Supplement Insurance Companies?

Yes. The California Birthday Rule can allow you to move from one Medicare Supplement insurance company to another, provided the new policy has equal or lesser benefits and you meet the requirements of the rule.

This is important because Medicare Supplement benefits are standardized by plan letter, but premiums can vary significantly among insurance companies.

For example, the core medical benefits of a standard Medicare Supplement Plan G are the same regardless of the insurance company offering the policy, but the premiums can be very different.

That means you may be able to keep the same Plan G benefits while moving to another company with a more competitive premium.

Do You Have to Answer Health Questions?

One of the biggest advantages of the California Medicare Birthday Rule is the ability to change to an eligible Medicare Supplement policy without medical underwriting.

That’s especially important because outside of an open enrollment or guaranteed-issue right, changing Medicare Supplement insurance may require medical underwriting depending on your circumstances.

Your birthday therefore gives you an opportunity each year to compare eligible plans regardless of changes in your health.

What Does “Equal or Lesser Benefits” Mean?

The Birthday Rule doesn’t allow you to move to just any Medicare Supplement plan without medical underwriting. Your new policy must provide benefits that are equal to or less than the benefits of your existing policy.

For example, someone with Plan G may be able to move to another Plan G offered by a different insurance company or potentially choose a plan with lesser benefits.

Because the rules can depend on the Medicare Supplement plan you currently have and the plan you’re considering, it’s important to confirm that the new plan qualifies under the Birthday Rule before applying.

Should You Compare Medicare Supplement Rates Every Birthday?

I think it’s worth reviewing your Medicare Supplement premium every year, even if you’re happy with your current coverage.

You may find that your existing insurance company is still competitively priced and there’s no reason to change.

But if your premium has increased and another insurance company offers eligible coverage at a meaningfully lower premium, the California Medicare Birthday Rule may give you an opportunity to lower your premium without medical underwriting.

And it’s important to compare the particular plan you’re considering. An insurance company that has a very competitive premium for Plan G may not necessarily have the most competitive premium for Plan N.
